Introduction
Age Restrictions for Users
Minimum Age Requirement Users must be at least 16 years of age to access and use our FiveM server. If a user is under 16, they must obtain consent from a parent or legal guardian before using the service.
Content Potentially Unsuitable for Minors Since the Passion Community server may contain content related to violence, physical harm, drugs, and gambling — which may not be suitable for users under 16-18 years of age — parents should use discretion in allowing their children to access the service.
Parental Responsibility Parents or legal guardians are responsible for monitoring and allowing underage users to use the service. If it is found that underage users are using the service without permission, we reserve the right to suspend or terminate the account without prior notice.
Account Suspension and Other Restrictions If a user provides false age information or violates the age requirements, we reserve the right to suspend or terminate access to the service without any refund or compensation, and without prior notice.
Welcome to the Passion Community FiveM Server. These Terms of Service set forth the terms and conditions proposed by our group of companies and affiliates (hereinafter individually and collectively referred to as “Passion city”, “Passion town”, “Passion city”, “Passion”, “we”, “us” or “our”).
- Providing server services in conjunction with Cfx.re FiveM and allowing Users to use the Platform via Personal Computer games.
- Providing Support services for "Users" to report issues on the Discord Platform and the Passion Community Rules website. These are hereinafter individually and collectively referred to as the “Service”.
- The Service includes any services provided on the Passion Community Server or website, as well as information, linked pages, features, data, text, images, photographs, graphics, music, sounds, videos, messages, tags, content, or other materials accessible by or through us. This includes User Generated Content (“UGC”) (hereinafter collectively referred to as “Content”).
“UGC” refers to any content of any format or nature that a user has uploaded, created, or published, or otherwise made to occur or appear through the use of the Service. Additionally, any modifications, edits, and new features added to or supplementing the Service are also subject to these Terms of Service. However, all Services and Content may not be available in all jurisdictions.
Please read these Terms of Service carefully before using this Service. So that you, as a user, acknowledge your legal rights and obligations with the Passion Community Server and our Services. “User” means a natural person who applies for a Visa (Whitelist confirmation) with us or accesses or uses our Services (individually and collectively referred to as “User”, “you” or “your”).
The Passion Community Server reserves the right to amend these Terms of Service at any time or upon notifying our users in accordance with applicable law. We will periodically update you on modifications to these Terms of Service. We recommend that you check this page regularly to be aware of any changes. And to the maximum extent permitted by applicable law, your continued access to or use of the Service constitutes irrevocable acceptance of these modifications.
The Passion Community Server reserves the right to change, modify, suspend, or discontinue any portion of the Service at any time. The Passion Community Server may offer certain services that may function, or may have errors or malfunctions, and we shall not be held liable in such cases.
The Passion Community Server reserves the right to refuse to provide you access to the Service or allow you to open an account for any reason.
Privacy
- Your privacy is of great importance to us at the Passion Community Server. To better protect your rights: The company has a policy of not selling your personal information to third parties, and we will not provide your personal information to third parties except in cases where we receive a court order or from a competent government agency requesting such information. And we are not responsible if data leaks occur from the Users themselves, or if others copy or access your personal information without your permission.
Limited License
- Under these Terms of Service, the Passion Community Server reserves all rights to:
- (scripts) Articles or code
- (Derivative Work) Ownership rights, computer code, objects
- (Catch Phrase) Locations, ideas, artwork
- (Artwork) Images
- (Graphic) Animations
- (Animation) Sounds, background music, techniques used to create sounds
- (Audio Visual Effect) Text, screen displays
- (Screen Display) Operational methods, moral rights
- (Applets) “Applets” which collectively constitute the Service, and any other related documentation
Granting you a non-exclusive license to use the Service subject to the terms and conditions of these Terms of Service for personal use only. Under this license, in addition to other uses, you may use the Service to create, develop, edit, upload, and publish UGC (to other users) as part of the game.
The above license (Section 3.1) does not permit you to use it for commercial purposes or any derivative use of the Service. The Passion Community Server reserves the right to revoke the license granted under these Terms of Service at any time. And under any condition, without prior notice, any rights.
The above license (Section 3.1) is the property of the Passion Community Server, which is enforceable, or third-party proprietary owners identified within this Service. You agree not to copy, distribute, republish, transmit, publicly display, modify, adapt, rent, sell, or create derivative works of any portion of the Service and its Content. Furthermore, without written consent from us, you may not mirror or frame any portion or all of this Service Content onto another server, or make it part of another website. Moreover, you agree that you will not use any Software or automated devices, or manual processes to monitor or copy our Content without our prior written consent. (Such consent is deemed given to standard search engine technology employed by Internet search websites to direct Internet users to this website.)
Terms of Use
The license to use the Service is effective until terminated. The license will terminate as set forth in these Terms of Service, or if you fail to comply with any term or condition of these Terms of Service. In such cases, the Passion Community Server is not required to provide notice to effectuate such termination.
You agree not to do the following:
- Upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, inaccurate, annoying, alarming, distressing, deceitful, defamatory, vulgar, offensive, libelous, invasive of another's privacy, malicious, or racially, ethnically or otherwise objectionable.
- Use the Service to harm minors or display content harmful to children or minors in any way.
- Use add-on programs or suspicious programs that cannot be immediately verified before or after opening the FiveM Launcher, or possess suspicious or unverifiable programs on the machine, or lacking clear user activity history at the time the team inspects. If an inspection is necessary, you must agree to let the team inspect the origin of the program and show transparency to the team. If the player refuses, it may affect their status on the server.
- Upload, post, email, transmit, or display content that infringes upon the rights, including patents, trademarks, copyrights, intellectual property, or proprietary rights of others.
- Use the Service to impersonate any person or entity, or falsely state your affiliation with a person or entity, forge headers or otherwise manipulate identifiers to disguise the origin of any content transmitted through the Service.
- Cause, permit, or authorize the modification, creation of derivative works, or translation of the Service without explicit permission from the Passion Community Server.
- Use the Service for commercial purposes or for the benefit of any third party or in any manner not permitted by the licenses granted herein.
- Use the Service for fraudulent or unlawful purposes, including any purposes related to or supporting money laundering or gambling, or not in compliance with or violating applicable laws.
- Attempt to decompile, reverse engineer, disassemble or hack our Service (or any portion thereof), or defeat or overcome any encryption technology or security measures implemented by the Passion Community Server for the Service, any network connected to or associated with the Service, and/or any data transmitted, processed or stored by the Passion Community Server.
- Upload, post, email, transmit, or create or display any content containing software viruses or any other computer code, files or programs designed to interfere, destroy, alter, and/or limit the functionality of the Service and/or computer resources belonging to the Passion Community Server or other users.
- Upload, post, email, transmit, or create or display any content that threatens the unity, integrity, defense, security, or sovereignty of the nation or jurisdiction you access or use any Services, good relations with foreign states, or public order, or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting to any other nation.
- Attempt to or improperly gain access to any part or feature of the Service, including other users' accounts.
- Upload, post, email, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
- Use modified, hacked, or unauthorized versions of the Service, including cheating, to gain an unfair advantage relative to other users or for any other purpose.
- Use the Service to violate any applicable laws, rules, codes, directives, guidelines, policies, or regulations of local, state, national, or international levels, including but not limited to laws or regulations (whether having the force of law or not) relating to anti-money laundering or counter-terrorism, directly or indirectly.
- Use the Service to provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act.
- Conduct, enable, cause, or permit any transactions (including payment or financial transactions) that you have no right to do.
- Attempt to sell or transfer your account or Virtual Currency and/or Virtual Items to any third party in any form.
- Use the Service to collect or store personal data about other users in connection with the prohibited conduct and activities set forth above.
- In the event your account is deleted or deactivated under the conditions set forth above, any “Virtual Currency” and “Virtual Items” (as defined) in your account will be forfeited without any refund for them, subject to the maximum extent permitted by applicable law.
Software Updates and Patches
We may update, revise, and change any part of the Service, which may not be notified to you in advance when modifying content or certain services.
You must always use the latest version of the software, which includes any updates and/or revisions. The Passion Community Server will not be liable for any loss or damage arising from your failure to use the latest version of the software or your use of an outdated version of the software.
Billing and Payment
In connection with our game and Services, you are offered the option to purchase Points or any in-game virtual money (“Virtual Currency”), any virtual items or in-game skins (“Virtual Items”), or other special features made available through our Services. Depending on your jurisdiction and the Service you choose to purchase, you may make payments to us or to third parties from time to time.
If you choose to make such purchases or incur any other charges related to the use of our Services, you agree to pay those charges to receive those Virtual Currency and Virtual Items. Or to gain access and/or benefits to such Services. The prices set for Virtual Currency and Virtual Items and/or Services do not include applicable taxes and currency exchange rates unless stated otherwise. You are solely responsible for the payment of such taxes and other charges. We may suspend or cancel any transaction and/or your access to the Service if we do not receive full payment from you by the stipulated due date.
Subject to the nature of the purchase and applicable laws, you will be able to check the date, time, and purchase amount of Virtual Currency, Virtual Items, or other Services in the purchase information window (F11).
Exceptions and Limitations of Liability
Your sole right against any problem or dissatisfaction with the Service is to stop using the Service.
In the event that (“Virtual Currency”), any virtual items or in-game skins (“Virtual Items”), or other special features provided through our Services are lost or compromised below the minimum condition value (300,000 Virtual Currency), you agree that the Passion Community Server will bear no liability.
Notwithstanding the preceding provisions, if a court of competent jurisdiction determines that the Passion Community Server must be liable (including for gross negligence) to you or to any third party, such liability shall be limited to less than ฿2,449 (Thai Baht) or the amount you paid during the 1 month preceding the event.
Nothing in these Terms of Service limits liability for fraud committed or for other liabilities arising from the User's own negligence.
