Preface
Age Restrictions for Users
Minimum Age Requirement Users must be at least 16 years old to access and use our FiveM server services. Users under 16 must obtain consent from a parent or legal guardian before use.
Content Potentially Unsuitable for Minors Passion Community servers may contain content related to violence, physical harm, drugs, and gambling, which may not be suitable for users under 16-18 years old. Parents should exercise discretion in allowing their children access.
Parental Responsibility Parents or legal guardians are responsible for reviewing and authorizing minors' access. If underage users are found using the service without authorization, we reserve the right to suspend or terminate accounts without notice.
Account Suspension and Other Restrictions If a user provides false age information or violates age requirements, we reserve the right to suspend or terminate access without refund or compensation, and without prior notice.
Welcome to Passion Community FiveM Server. These Terms of Service establish the terms and conditions set by the company group and affiliates (hereinafter individually and collectively referred to as "Passion City", "Passion Town", "Passion", "we", "us", or "our") offering:
- Server services in collaboration with Cfx.re FiveM, available to users via Personal Computer gaming
- Support services for reporting issues on the Discord platform and the Passion Community Rules website (hereinafter individually and collectively referred to as "Services")
- Services include any services available on Passion Community Server or website, and data, linked pages, features, text, images, photos, graphics, music, sounds, videos, messages, tags, content, or other media accessible through us, including User Generated Content ("UGC") (collectively referred to as "Content").
"UGC" means content in any form or manner uploaded, created, published, or made to appear by users through the use of our services. Additionally, any modifications, edits, and new features added to or enhancing the services are also subject to these Terms of Service. However, not all services and content are available in every country or jurisdiction.
Please read these Terms of Service carefully before using our services, so that you as a user understand your legal rights and obligations with Passion Community Server and our services. "User" refers to any natural person who applies for a Visa (Whitelist verification) with us, or who accesses or uses our services (individually and collectively referred to as "user", "you", or "your").
Passion Community Server reserves the right to modify these Terms of Service at any time, or as required by applicable law. We will periodically update you on amendments. We recommend checking this page regularly for changes. By continuing to access or use the services, you irrevocably accept these amendments to the fullest extent permitted by law.
Passion Community Server reserves the right to change, modify, suspend, or terminate any part of the services at any time. Some services may have operational issues or anomalies, and we shall not be liable in such cases.
Passion Community Server reserves the right to deny you access to the services or prevent you from opening an account for any reason.
Privacy
- Your privacy is extremely important to us at Passion Community Server. To better protect your rights, we have no policy of selling your personal data to third parties. We will not provide your personal information to external parties except when ordered by a court or authorized government agency. We are not responsible if data is leaked by the user themselves, or if another person copies or accesses your personal information without your authorization.
Limited License
- Under these Terms of Service, Passion Community Server reserves all rights regarding:
- (Scripts) articles or code
- (Derivative Work) ownership rights, computer code, objects
- (Catch Phrase) locations, ideas, artwork
- (Artwork) images
- (Graphics) animations
- (Animation) sounds, soundtracks, sound effects
- (Audio Visual Effect) text, screen displays
- (Screen Display) methods of operation, moral rights
- (Applets) "applets" which collectively form the services, and any other related documentation
You are granted a non-exclusive license to use the services under the terms and conditions of these Terms of Service for personal use only. Under this license, you may use the services to create, develop, modify, upload, and distribute UGC (to other users) as part of the game.
The above license (Section 3.1) does not permit commercial use or any derivative use of Passion Community Server services. We reserve the right to revoke this license at any time, under any conditions, without prior notice.
The above license (Section 3.1) is the property of Passion Community Server and is enforceable, or belongs to third-party rights holders identified in the services. You agree not to copy, distribute, republish, transmit, publicly display, modify, adapt, rent, sell, or create derivative works from any part of the services and content. Without our written consent, you may not replicate any portion of the service content on another server or incorporate it into another website. Furthermore, you agree not to use any automated software, devices, or manual processes to monitor or copy our content without prior written consent.
Terms of Use
The license to use the services is effective until terminated. The license terminates as specified in these Terms of Service, or if you fail to comply with any terms or conditions. Passion Community Server is not required to provide notice for such termination to take effect.
You must agree not to:
- Upload, post, email, transmit, or otherwise make available any content that is illegal, harmful, threatening, inaccurate, harassing, causing panic, distressing, deceptive, defamatory, vulgar, offensive, slanderous, invasive of others' privacy, malicious, or racially/ethnically discriminatory
- Use the services to harm minors or display content harmful to children or minors in any way
- Use supplementary or suspicious programs that cannot be immediately verified, before or after launching the FiveM launcher, or possess suspicious programs on your device. If investigation is necessary, you must allow staff to verify program origins and demonstrate transparency. Refusal may affect your server status
- Upload, post, email, transmit, or display content that infringes on patents, trademarks, copyrights, intellectual property, or proprietary rights of others
- Use the services to impersonate any person or entity, or falsely represent your affiliation with any person or entity, forge headers or otherwise manipulate identifiers to disguise the origin of content
- Create, permit, or authorize modification, derivative works, or translation of the services without explicit permission from Passion Community Server
- Use the services for commercial purposes, third-party benefit, or in any unauthorized manner
- Use the services for fraudulent or illegal purposes, including money laundering, gambling, or violation of applicable laws
- Attempt to reverse engineer, decompile, disassemble, or hack the services, create networks connected to the services, or attempt to breach encryption or security measures
- Upload, post, or create content containing viruses, malicious code, files, or programs designed to interfere with, destroy, modify, or restrict the services
- Upload, post, or create content that threatens national sovereignty, integrity, defense, security, or jurisdiction, international relations, or incites serious offenses
- Attempt to access any part or feature of the services without authorization, including other users' accounts
- Upload, post, or transmit content that infringes on patents, trademarks, trade secrets, copyrights, or proprietary rights
- Use the services in a modified, hacked, or unauthorized manner, cheat, gain unfair advantages over other users
- Use the services to violate any local, state, national, or international laws, regulations, codes, directives, policies, or ordinances, including anti-money laundering and anti-terrorism laws
- Use the services to provide support materials or resources to organizations designated as foreign terrorist organizations
- Enable any unauthorized transactions, including payment or financial transactions
- Attempt to sell or transfer your account, Virtual Currency, and/or Virtual Items to any other person in any form
- Use the services to collect personal information about other users in connection with prohibited activities
- If your account is deleted or disabled under the above conditions, your Virtual Currency and Virtual Items will be forfeited without any refund, to the fullest extent permitted by applicable law.
Software Updates and Patches
We may update, modify, and change the services, which may not always be communicated to you in advance.
You must always use the latest version of the software, including any updates and improvements. Passion Community Server is not responsible for any loss or damage resulting from your failure to use the latest software version.
Billing and Payments
In connection with our games and services, you may be offered the option to purchase Points or Virtual Currency, Virtual Items or skins, or other special features provided through our services. This depends on your jurisdiction and the services you choose to purchase, and you may make payments to us or third parties periodically.
If you choose to make such purchases or take any action that incurs charges related to our services, you agree to pay those costs. Prices for Virtual Currency and Virtual Items do not include applicable taxes and currency exchange rates unless otherwise specified. You are solely responsible for payment of such taxes and other costs. We may suspend or cancel transactions and/or your access if full payment is not received by the due date.
You can check the date, time, and amount of Virtual Currency, Virtual Items, or other service purchases in the purchase information window (F11), subject to purchase conditions and applicable law.
Limitation of Liability
Your sole remedy for any problem or dissatisfaction with the services is to stop using the services.
If Virtual Currency, Virtual Items, or other special features are lost or violated below the minimum value threshold (300,000 Virtual Currency), you accept that Passion Community Server is not responsible.
Regardless of the foregoing, if a court of competent jurisdiction finds Passion Community Server liable (including gross negligence) to you or any third party, such liability shall be limited to the lesser of ฿2,449 (Thai Baht) or the amount you paid in the 1 month prior to the event.
Nothing in these Terms of Service limits liability for fraud or other liability arising from the user's own negligence.
